What Is a Retention Hearing?

When the county seizes a vehicle as a result of a misdemeanor DWI, the law requires that there be a retention hearing with 15 days of the arrest. In this hearing, a judge determines whether the vehicle can be retained by the county until the criminal case is resolved.
